1. Purpose and Responsible Controller

This privacy policy explains the nature, scope and purpose of the processing (including collection, processing and use as well as obtaining consent) of personal data within our online offering and the websites, functions and content associated with it (hereinafter jointly referred to as “online offering” or “website”). The privacy policy applies regardless of the domains, systems, platforms and devices (e.g. desktop or mobile) on which the online offering is operated.

The provider of the online offering and the controller responsible under data protection law is Marc Ohlenforst, Kreuzstraße 4, 41849 Wassenberg-Effeld (hereinafter referred to as “provider”, “we” or “us”). For contact options, please refer to our Imprint

The term “user” covers all customers and visitors of our online offering. Terms used, such as “user”, are to be understood as gender-neutral.

2. General Information on Data Processing

We process users’ personal data only in compliance with the applicable data protection regulations and in accordance with the principles of data minimisation and data avoidance. This means users’ data is only processed where there is a legal basis, in particular where the data is required to provide our contractual services and online services, or is required by law, or where consent has been given.

We take organisational, contractual and technical security measures in line with the state of the art to ensure compliance with data protection law and to protect the data we process against accidental or intentional manipulation, loss, destruction or access by unauthorised persons.

Where content, tools or other means from other providers (hereinafter jointly referred to as “third-party providers”) are used within this online offering and their registered office is abroad, it must be assumed that data will be transferred to the third-party providers’ home countries. Data is transferred to third countries either on the basis of legal permission, user consent or special contractual clauses that ensure the legally required security of the data.

3. Processing of Personal Data

In addition to the uses expressly stated in this privacy policy, personal data is processed for the following purposes on the basis of legal permissions or user consent:
– providing, performing, maintaining, optimising and securing our services and user benefits;
– ensuring effective customer service and technical support.

We only transfer users’ data to third parties where necessary for billing purposes (e.g. to a payment service provider) or for other purposes where necessary to fulfil our contractual obligations towards users (e.g. communicating addresses to suppliers).

When you contact us (via contact form or email), your details are stored for the purpose of processing the inquiry and in case follow-up questions arise.
Personal data is deleted once it has fulfilled its purpose and provided no retention obligations prevent deletion.

4. Collection of Access Data

We collect data on every access to the server on which this service is located (so-called server log files). Access data includes the name of the retrieved website, file, date and time of retrieval, amount of data transferred, notification of successful retrieval, browser type and version, the user’s operating system, referrer URL (the previously visited page), IP address and the requesting provider.

We use the log data without attributing it to individuals or any other profiling, in accordance with legal provisions, only for statistical evaluation for the purpose of operating, securing and optimising our online offering. However, we reserve the right to retrospectively review the log data if concrete evidence gives rise to justified suspicion of unlawful use.

5. Cookies & Reach Measurement

Cookies are information transmitted from our web server or third-party web servers to users’ web browsers and stored there for later retrieval. Users are informed about the use of cookies in the context of pseudonymous reach measurement within this privacy policy.

This online offering can also be viewed with cookies disabled. If users do not want cookies stored on their computer, they are asked to disable the corresponding option in their browser’s system settings. Stored cookies can be deleted in the browser’s system settings. Disabling cookies may lead to functional limitations of this online offering.

Many online advertising cookies from companies can be managed via the US site http://www.aboutads.info/choices or the EU site http://www.youronlinechoices.com/uk/your-ad-choices/ can be managed.

6. Google Analytics

We use Google Analytics, a web analytics service provided by Google Inc. (“Google”). Google uses cookies. The information generated by the cookie about users’ use of the online offering is generally transmitted to and stored on a Google server in the USA.

Google will use this information on our behalf to evaluate users’ use of our online offering, to compile reports on activities within this online offering and to provide further services associated with the use of this online offering and internet usage. Pseudonymous user profiles may be created from the processed data.

We use Google Analytics only with IP anonymisation enabled. This means users’ IP addresses are shortened by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases is the full IP address transmitted to a Google server in the USA and shortened there.

The IP address transmitted by the user’s browser is not merged with other Google data. Users can prevent cookies from being stored by adjusting their browser software settings; users can also prevent the collection of data generated by the cookie relating to their use of the online offering (including transmission to Google) and the processing of this data by Google by downloading and installing the browser plug-in available at the following link: http://tools.google.com/dlpage/gaoptout?hl=de.

Further information on Google’s use of data for advertising purposes and on settings and opt-out options can be found on Google’s websites: https://www.google.com/intl/de/policies/privacy/partners (“How Google uses data when you use our partners’ sites or apps”), http://www.google.com/policies/technologies/ads (“How Google uses data for advertising”), http://www.google.de/settings/ads (“Manage the information Google uses to show you ads”) and http://www.google.com/ads/preferences (“Control the ads Google shows you”).

7. Google Re/Marketing Services

We use the marketing and remarketing services (collectively “Google Marketing Services”) of Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”).

Google Marketing Services allow us to display advertisements for and on our website in a more targeted manner, so that users are only shown ads that potentially match their interests. If users are shown ads for products they were interested in on other websites, this is known as “remarketing”. For these purposes, when our website and other websites on which Google Marketing Services are active are accessed, code from Google is executed directly by Google and so-called (re)marketing tags (invisible graphics or code, also known as “web beacons”) are embedded in the website. With their help, an individual cookie – a small file – is stored on the user’s device (comparable technologies may also be used instead of cookies). Cookies may be set by various domains, including google.com, doubleclick.net, invitemedia.com, admeld.com, googlesyndication.com or googleadservices.com. This file records which websites the user has visited, which content they are interested in and which offers they have clicked, as well as technical information about the browser and operating system, referring websites, time of visit and other details of online offering use. The user’s IP address is also collected; in the context of Google Analytics we note that the IP address is shortened within member states of the European Union or in other contracting states of the Agreement on the European Economic Area and only in exceptional cases transmitted in full to a Google server in the USA and shortened there. The IP address is not merged with user data from other Google offerings. The aforementioned information may also be combined with such information from other sources. If the user subsequently visits other websites, they may be shown ads tailored to their interests.

User data is processed pseudonymously within Google Marketing Services. This means Google does not store and process, for example, users’ names or email addresses, but processes the relevant data on a cookie basis within pseudonymous user profiles. From Google’s perspective, ads are therefore not managed and displayed for a specifically identified person, but for the cookie holder, regardless of who that cookie holder is. This does not apply if a user has expressly permitted Google to process the data without this pseudonymisation. Information collected about users by “DoubleClick” is transmitted to Google and stored on Google’s servers in the USA.

The Google Marketing Services we use include the online advertising programme “Google AdWords”. With Google AdWords, each AdWords customer receives a different “conversion cookie”. Cookies therefore cannot be tracked across AdWords customers’ websites. The information collected with the help of the cookie is used to create conversion statistics for AdWords customers who have opted for conversion tracking. AdWords customers learn the total number of users who clicked on their ad and were redirected to a page with a conversion tracking tag. However, they do not receive any information that could personally identify users.

We integrate third-party advertisements based on the Google Marketing Service “DoubleClick”. DoubleClick uses cookies which enable Google and its partner websites to serve ads based on users’ visits to this website and other websites on the internet.

We also integrate third-party advertisements based on the Google Marketing Service “AdSense”. AdSense uses cookies which enable Google and its partner websites to serve ads based on users’ visits to this website and other websites on the internet.

Another Google Marketing Service we use is “Google Tag Manager”, which allows further Google analytics and marketing services to be integrated into our website (e.g. “AdWords”, “DoubleClick” or “Google Analytics”).

Further information on Google’s use of data for marketing purposes can be found on the overview page: https://www.google.com/policies/technologies/ads, Google’s privacy policy is available at https://www.google.com/policies/privacy.

If you wish to object to collection by Google Marketing Services, you can use the settings and opt-out options provided by Google: http://www.google.com/ads/preferences.

8. Facebook Social Plugins

Our online offering uses social plugins (“plugins”) of the social network facebook.com, which is operated by Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland (“Facebook”). The plugins are recognisable by one of the Facebook logos (white “f” on a blue tile, the terms “Like” or a “thumbs up” icon) or are labelled “Facebook Social Plugin”. The list and appearance of the Facebook social plugins can be viewed here: https://developers.facebook.com/docs/plugins/.

When a user accesses a function of this online offering that contains such a plugin, their device establishes a direct connection with Facebook’s servers. The content of the plugin is transmitted by Facebook directly to the user’s device and integrated into the online offering. Usage profiles of users may be created from the processed data. We therefore have no influence on the scope of the data that Facebook collects with the help of this plugin and inform users accordingly to the best of our knowledge.

By embedding the plugins, Facebook receives the information that a user has accessed the corresponding page of the online offering. If the user is logged in to Facebook, Facebook can associate the visit with their Facebook account. When users interact with the plugins, for example by pressing the Like button or leaving a comment, the corresponding information is transmitted from their device directly to Facebook and stored there. Even if a user is not a member of Facebook, Facebook may still learn and store their IP address. According to Facebook, only an anonymised IP address is stored in Germany.

Users can find the purpose and scope of data collection and the further processing and use of data by Facebook, as well as the related rights and settings options to protect users’ privacy, in Facebook’s privacy notices: https://www.facebook.com/about/privacy/.

If a user is a Facebook member and does not want Facebook to collect data about them via this online offering and link it to their Facebook membership data, they must log out of Facebook before using our online offering and delete their cookies. Further settings and objections to the use of data for advertising purposes are possible within the Facebook profile settings: https://www.facebook.com/settings?tab=ads or via the US site http://www.aboutads.info/choices/ or the EU site http://www.youronlinechoices.com/. These settings apply across platforms, i.e. they are adopted for all devices such as desktop computers or mobile devices.

9. Facebook Remarketing

Our online offering uses so-called “Facebook pixels” of the social network Facebook, which is operated by Facebook Inc., 1 Hacker Way, Menlo Park, CA 94025, USA, or, if you are resident in the EU, Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland (“Facebook”). With the help of the Facebook pixel, Facebook can identify visitors to our offering as a target group for displaying ads, so-called “Facebook ads”. Accordingly, we use the Facebook pixel to show the Facebook ads we place only to Facebook users who have also shown an interest in our website. In other words, with the help of the Facebook pixel we want to ensure that our Facebook ads match users’ potential interests and are not intrusive. With the help of the Facebook pixel, we can also track the effectiveness of Facebook ads for statistical and market research purposes by seeing whether users were redirected to our website after clicking on a Facebook ad.

The Facebook pixel is integrated directly by Facebook when our websites are accessed and can store a so-called cookie – a small file – on your device. If you subsequently log in to Facebook or visit Facebook while logged in, the visit to our offering is recorded in your profile. The data collected about you is anonymous to us and therefore provides no conclusions about users’ identities. However, the data is stored and processed by Facebook so that it can be linked to the respective user profile. Data is processed by Facebook in accordance with Facebook’s Data Policy. You can find further information on how the remarketing pixel works and generally on the display of Facebook ads in Facebook’s Data Policy: https://www.facebook.com/policy.php.

You can object to collection by the Facebook pixel and to the use of your data for displaying Facebook ads. To do so, visit the page set up by Facebook and follow the instructions on settings for interest-based advertising there: https://www.facebook.com/settings?tab=ads or declare your objection via the US site http://www.aboutads.info/choices/ or the EU site http://www.youronlinechoices.com/ . These settings apply across platforms, i.e. they are adopted for all devices such as desktop computers or mobile devices.

10. Integration of Third-Party Services and Content

Content or services from third-party providers, such as city maps or fonts from other websites, may be integrated within our online offering. Integrating third-party content always requires third-party providers to perceive users’ IP addresses, as they could not send the content to users’ browsers without the IP address. The IP address is therefore required to display this content. Furthermore, third-party content providers may set their own cookies and process users’ data for their own purposes. Usage profiles of users may be created from the processed data. We will use this content in as data-efficient and data-avoiding a manner as possible and will choose reliable third-party providers with regard to data security.

The following overview lists third-party providers and their content, along with links to their privacy policies, which contain further information on data processing and, some already mentioned here, opt-out options:

– External fonts from Google Inc., https://www.google.com/fonts (“Google Fonts”). Google Fonts are integrated via a server call to Google (generally in the USA). Privacy policy: https://www.google.com/policies/privacy/, Opt-Out: https://www.google.com/settings/ads/.

– Maps from the “Google Maps” service of third-party provider Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. Privacy policy: https://www.google.com/policies/privacy/, Opt-Out: https://www.google.com/settings/ads/.

– Videos from the “YouTube” platform of third-party provider Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. Privacy policy: https://www.google.com/policies/privacy/, Opt-Out: https://www.google.com/settings/ads/.

Google Maps
This site uses the Google Maps map service. The provider is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland. To use Google Maps features, it is necessary to store your IP address. This information is generally transmitted to and stored on a Google server in the USA. The provider of this site has no influence on this data transfer. When Google Maps is activated, Google may use Google Web Fonts for uniform font display. When Google Maps is accessed, your browser loads the required web fonts into its browser cache to display texts and fonts correctly.

Google Maps is used in the interest of an appealing presentation of our online offerings and to make the places indicated on the website easy to find. This constitutes a legitimate interest within the meaning of Art. 6 (1) (f) GDPR. Where corresponding consent has been obtained, processing is carried out exclusively on the basis of Art. 6 (1) (a) GDPR and § 25 (1) TTDSG, insofar as consent covers the storage of cookies or access to information on the user’s device (e.g. device fingerprinting) within the meaning of the TTDSG. Consent can be revoked at any time.

Data transfer to the USA is based on the EU Commission’s Standard Contractual Clauses. Details can be found here: https://privacy.google.com/businesses/gdprcontrollerterms/ and https://privacy.google.com/businesses/gdprcontrollerterms/sccs/.
More information on how Google handles user data can be found in Google’s privacy policy: https://policies.google.com/privacy?hl=de.

11. User Rights and Data Deletion

Users have the right to obtain, upon request and free of charge, information about the personal data we have stored about them.
In addition, users have the right to rectification of inaccurate data, withdrawal of consent, blocking and deletion of their personal data, as well as the right to lodge a complaint with the competent supervisory authority if they believe data processing is unlawful.

Data stored by us is deleted once it is no longer required for its intended purpose and provided no statutory retention obligations prevent deletion.

12. Borlabs Cookie

This website uses Borlabs Cookie, which sets two technically necessary cookies (borlabsCookie and borlabsCookieUnblockContent) to store your cookie preference. Borlabs Cookie does not process any personal data. The borlabsCookie cookie stores the preference you selected when entering the website. The borlabsCookieUnblockContent cookie stores which (external) media/content you always want to have unblocked automatically. If you wish to revoke these settings, simply delete the cookies in your browser. When you re-enter/reload the website, you will be asked for your cookie preference again.

13. Changes to This Privacy Policy

We reserve the right to change the privacy policy in order to adapt it to changed legal situations or to changes in the service and data processing. However, this applies only with regard to explanations of data processing. Where user consent is required or components of the privacy policy contain provisions governing the contractual relationship with users, changes will only be made with user consent.
Users are asked to inform themselves regularly about the content of the privacy policy.
